Privacy Policy
Vidy AI, operated by PixelByte LLC (collectively, “the application,” “we,” “us,” or “our”), respects your privacy. We have developed this Privacy Statement (referred to as “this Statement”) to help you understand how we collect, use, disclose, protect, store, and transmit your personal data. Please take a moment to read this Statement carefully and contact us if you have any questions.
This Statement applies to our products and services that display or mention this Statement.
I. How We Collect and Use Your Personal Data
How We Collect Your Personal Data
“Personal information” refers to any type of information recorded electronically or otherwise relating to an identified or identifiable natural person, excluding information that has been anonymized. We may collect your personal data when you use our products or services or interact with us. Different types of data will be collected, depending on the service you use and your interactions with us. In some cases, you can choose not to provide such data, but this may prevent us from providing you with corresponding products or services, or may mean that we cannot respond to or resolve any issues you have raised.
The personal and sensitive user data we collect includes but is not limited to:
• Personal identifiers (such as name, email address)
• Device identifiers
• Camera data (when you use camera-related features)
• App usage data and analytics
• Device information and other installed apps list
When providing you with related products or services, we may also collect and summarize statistics, such as website visits, app downloads, and product sales volume, to understand how our products and services are used. For the purposes of this Statement, such statistics are regarded as non-personal data. We will try our best to isolate your personal data from non-personal data and use them separately. If personal data becomes mixed with non-personal data, we will still treat it as personal data.
We will collect and use your personal data only for the purposes described in this Statement and any Product Privacy Notice associated with Vidy AI.
Below are some examples of the personal data we may collect:
1. Personal data that you provide to us
You need to register an account (an ID) for Vidy AI to enjoy certain functions or services. When you register or log in to your account, we may ask you to provide relevant personal data.
Some of our products allow you to communicate and share information with others. When you use these features to share content with family or friends, you may be required to create an open profile (which can include your nickname and avatar). We may also collect information about your family and friends, such as their names, email addresses, and phone numbers. We take appropriate and necessary measures to ensure the security of such communications.
2. Information that we collect when you use our services
When you use our products and services, we will collect device information and how you and your device interact with our products and services. Such information includes:
a. Device and app information: Device name, device identifier, device activation time, hardware model, operating system version, app version, software identifier, and device/app settings (such as region, language, time zone, font size).
b. Mobile network information: Public land mobile network (PLMN) provider ID, geographical location (cell ID of the area where the device is located), and IP address.
c. Log information: When you use our services or view content provided by us, we automatically collect and log certain information, such as the time of access, number of accesses, IP address, and event information (errors, crashes, restarts, updates).
d. Location information: When you access certain location-based services, we collect, use, and process the approximate or precise location of your device (via GPS, WLAN, or service provider network ID). You can refuse to share your location at any time by disabling the corresponding permission.
e. Information stored in the cloud: For example, any data you upload to the cloud is stored on servers for rapid access and sharing between devices. No one can access such information without your permission.
3. Information from third-party sources
When permitted by local laws, we may also obtain other information about you, your device, or your service usage from public or legitimate commercial sources. For example, we may obtain your information from a third party when you log in to our application using a third-party social media account, or when your contact information is uploaded by others who use our communication services.
How We Use Your Personal Data
We use your personal data only on a legal basis. Depending on applicable local laws, we may use your personal data for the following purposes, as long as one of the following legal bases applies: (i) your consent; (ii) as necessary to perform or enter into a contract between you and us; (iii) as necessary to protect your or others’ legitimate interests; (iv) as necessary to fulfill legal obligations; or (v) as necessary to protect our legitimate interests:
1. Register and activate the products or services that you have purchased.
2. Register your Vidy AI account to enable a wider range of features.
3. Deliver, activate, or verify products and services you have requested; perform changes; and provide technical and after-sales support at your request.
4. Notify you of operating system or application updates and installations.
5. Provide a personalized user experience and content.
6. With your consent or upon your request, send you information about products or services you might be interested in, invite you to participate in market surveys, or send you marketing information.
7. Conduct internal audits, data analyses, and research to analyze business operations and measure market shares, in order to improve our products and services.
8. Troubleshoot problems after you send us error details.
9. Synchronize and store the data you have uploaded or downloaded, as well as data needed for uploads and downloads.
10. Improve our loss prevention and anti-fraud programs.
11. Comply with applicable local laws or regulations, and fulfill lawful requests from government authorities.
Data Security and Transfer
We handle all personal and sensitive user data securely, including:
• Using modern encryption technologies (such as HTTPS) for data transmission.
• Implementing runtime permissions for accessing Android permission-controlled data.
• Never selling personal and sensitive user data to third parties.
“Selling” means exchanging or transferring personal and sensitive user data to third parties for monetary compensation. User-initiated data transfers (e.g., when a user uses an app feature to transfer files to a third party) are not considered selling.
II. How We Use Cookies and Similar Technologies
We may use cookies, pixel tags, web beacons, and other local storage technologies in our websites, online services, emails, and advertisements. The information collected through cookies and similar technologies is generally regarded as non-personal data. However, if local laws treat IP addresses or similar identifiers as personal data, we will also treat them as personal data. In some cases, we may combine non-personal data collected via these technologies with personal data we hold, in which case we will treat all such combined data as personal data.
Cookies
A cookie is a text file created by a web server and stored on a computer or mobile device. The content of a cookie can only be retrieved or read by the server that created it. Cookies are unique to the browser or mobile application you use. They usually contain identifiers, site names, numbers, and characters.
Cookies may be stored on your computers or mobile devices to improve user experience:
1. Necessary cookies
• Login and verification: When you use your Vidy AI account to log in, cookies help you navigate from page to page without having to log in repeatedly.
• Storage of preferences and settings: Cookies can save your personal settings, such as language, font size, and other browsing preferences.
2. Analysis cookies
• Statistical analysis: With cookies, we can collect information about your use of our websites, recording a single visit (session cookie) or multiple visits (persistent cookie).
3. Advertisement cookies
• Interest-based advertising: Cookies help us collect information about your online activities, discover your interests, and deliver highly relevant advertisements to you.
You can manage or delete cookies based on your preferences. Most web browsers allow you to clear or block cookies. For details on how to change browser settings, consult your browser’s provider.
If you clear cookies, you may need to adjust your settings every time you visit our websites. Disabling cookies may affect your use of some or all services provided by us.
Website Beacons and Pixel Tags
In addition to cookies, we may also use other similar technologies on our websites, such as web beacons and pixel tags:
• Web beacon: An electronic image embedded into a website or email to identify cookies on your device when you visit that website or email.
• Pixel tags: Allow us to send emails in a readable format and determine whether emails have been opened.
We and our third-party partners may use these technologies for various purposes, including analyzing service usage (together with cookies) and providing you with better content and advertisements. For example, an email we send you may include a click-through URL that links to our website; if you click the link, we track your visit to better understand your product/service preferences.
Other Local Storage
We and our third-party partners may use other local storage technologies (e.g., local shared objects, known as “flash cookies,” and HTML5 local storage) in some products and services. These technologies function similarly to cookies by storing information on your device and recording some details about your activities and preferences, but may use different storage methods. You may not be able to control them with standard browser tools and settings.
Do Not Track
Many web browsers have a Do Not Track feature that can send Do Not Track requests to websites. Major Internet standardization organizations have yet to establish policies for how websites should respond to these requests. Currently, we do not change how we handle cookies based on any Do Not Track settings you have selected.
III. How We Entrust, Share, Transfer, and Disclose Your Personal Data
Entrusting
In some cases, we may entrust other companies to process your personal data on our behalf. For example, we may entrust a company to provide hotline support, send emails, or provide technical support. These companies may only use your personal data to deliver services on our behalf.
We will enter into strict agreements or personal data processing terms with the entrusted party. The entrusted party must process personal data in accordance with this Statement and our instructions, and is obligated to take confidentiality and security measures to ensure data security.
Sharing
Sharing refers to providing personal data to other entities that can independently determine the data processing purposes and methods. We will not share your personal data with external parties except in the following circumstances:
1. Sharing with your consent: After obtaining your consent, we will share only the personal data you have authorized with third parties designated by you.
2. Sharing under statutory circumstances: We may share your personal data in accordance with laws, regulations, litigation requirements, or the lawful requests of administrative and judicial authorities.
3. Sharing with our affiliates: Your data may be shared with our affiliates, but only for specific, legitimate purposes, and only the necessary data will be shared.
4. Sharing with business partners: To deliver high-quality services, we may share your order, account, device, and location information with third-party partners. However, we only share your personal data for legitimate, necessary, and specific purposes.
Before sharing, we perform security assessments on both the sharing action and the recipients. We sign data protection agreements or strict confidentiality agreements requiring them to comply with this Statement and implement appropriate security measures.
Transfer
In the event of a merger, acquisition, division, dissolution, or bankruptcy, personal data may be transferred. We will notify you beforehand of the recipient’s name and contact details and require that your personal data continue to be processed according to this Statement. If the new recipient changes the original processing purpose or method, they must obtain your consent again.
Public Disclosure
We will only disclose your personal data in the following cases:
1. With your explicit consent.
2. When disclosure is legally or reasonably required by laws, legal processes, litigation, or public and government authorities.
IV. How We Protect Your Personal Data
We adopt industry-standard practices to protect your personal data from unauthorized access, disclosure, use, modification, damage, or loss. This includes:
• Taking all reasonable measures to ensure the personal data collected is the minimum necessary for its processing purposes.
• Using cryptographic technologies for secure data transmission and storage, and deploying trusted protection mechanisms to prevent attacks on servers that store data.
• Implementing access control measures to restrict access to personal data, with hierarchical permissions for different personnel. Access to personal data is logged and regularly audited.
• Carefully selecting business partners and service providers, incorporating data protection requirements into contracts, audits, and assessments.
• Organizing security and privacy protection trainings and awareness programs for employees.
No security measure, however, is perfect. No product, service, website, data transmission, computer system, or network connection is absolutely secure.
Should any personal data security incident occur, we will notify you as required by local law—providing details of the incident, possible impact, the actions taken or planned by us, and suggestions for mitigating risks. Such notifications may be via email, text message, or push notification. If it is difficult to notify individuals, we will release a security notice through effective channels. We also report personal data security incidents to relevant supervisory authorities as required by law.
V. How You Can Manage Your Personal Data
Personal Data Subjects’ Rights (Access, Correction, Deletion)
Depending on local laws, personal data subjects (or authorized representatives) may submit requests (“requests”) to exercise certain rights.
1. Requesting methods and channels
• Requests should typically be submitted in writing.
• You may submit your request through official channels associated with Vidy AI (for example, in-app support or email).
2. Validity of requests
• Provide enough information for us to verify your identity (to ensure the person making the request is either the data subject or someone legitimately authorized).
• Clearly describe the type of request and the information involved.
3. Request processing period
• We strive to respond within a reasonable timeframe after receiving your request.
4. Request outcomes
• We may decline requests that do not meet legal requirements or cannot be verified.
• If we accept your request, we will proceed accordingly and inform you of the outcome.
5. Special notes
• Only legal guardians or legally authorized persons can access a minor’s personal data.
• In certain circumstances, we may refuse to provide data if it could interfere with ongoing anti-terrorism efforts or involve disproportionate resources, among other reasons specified by law.
• We typically do not provide information about others, repeated requests for identical information, or confidential documents.
Withdrawal of Consent
When our processing of your personal data is based on your consent, you have the right to withdraw such consent at any time, as permitted by applicable law. However, withdrawal of consent does not affect the legality or effectiveness of data processing activities based on your consent before the withdrawal.
VI. How We Process the Personal Data of Minors
We pay special attention to the protection of minors’ personal data. We follow relevant laws and regulations regarding minors. Parents or other guardians should also take appropriate measures to protect minors, including supervising their use of our products or services.
We treat anyone under the age of 14 (or the age set by local law) as a child. Children may not create Vidy AI accounts without parental or guardian consent. We strictly limit any entrusting, sharing, transferring, or public disclosure of minors’ data. If a guardian needs to access, correct, or delete a minor’s personal data, please contact us using the methods described in Chapter X: How to Contact Us. If we discover that a child’s personal data has been collected without prior consent from authenticated parents or guardians, we will delete the data as soon as possible.
VII. Links to Third-Party Websites, Products, and Services
For your convenience, Vidy AI and its related products or services may contain links to third-party websites, products, and services. These third parties operate independently of us, and we do not control them. You may choose whether to visit those links.
Because these third parties are not bound by this Statement, we are not responsible for their privacy or data protection policies. We recommend that you read the privacy policies of any third-party websites or services before submitting your personal data to them.
VIII. International Data Transfer
We are headquartered in the United States and may use service providers that operate in other countries. Your personal information may be transferred to, or stored in, the United States or other locations where privacy laws may not be as protective as those in your state, province, or country.
IX. Updates to This Statement
We reserve the right to update this Statement at any time. For the latest version, please visit our official website or in-application links. If major changes are made to this Statement, we may notify you through multiple channels, such as posting a notice within the application or sending you a direct notification.
X. How to Contact Us
If you have any questions, comments, or suggestions, please contact us via:
• Email: support@pixelbyte.app
We will generally reply within the timeframe specified by relevant laws and regulations. If you are not satisfied with our response—particularly if you believe your legal rights regarding personal data have been infringed—you may lodge a complaint with or report to local data protection authorities.
